This website is operated by Laurin Marcel Medwed e.U. and hosted by Shopify Inc. This means that Shopify Inc. provides us with the online e-commerce platform to sell our products and services to you.

Throughout the website, the terms "we," "us," and "our" refer to Laurin Marcel Medwed e.U. We provide you with this website, including all information, tools, and services available on this site, subject to your acceptance of all the terms, conditions, policies, and notices stated here.

By visiting our website and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions. They are accessible via a hyperlink. These terms and conditions apply to all users of the website, including but not limited to browsers, vendors, customers, merchants, and/or content contributors.

Please read these terms and conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these terms and conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these terms and conditions are considered an offer, acceptance is expressly limited to these terms and conditions.

Any new features or tools added to the current online store shall also be subject to these terms and conditions. We reserve the right to update, change, or replace any part of these terms and conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

By agreeing to these terms and conditions, you represent that you are at least the age of majority in your state or province of residence or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this online store.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the terms will result in an immediate termination of your services.

Scope

These terms and conditions apply to all purchases of products made by consumers from the online store: www.stickyslat.com.

Consumers are all individuals who are not entrepreneurs within the meaning of § 1 para. 1 Z 1 of the Austrian Consumer Protection Act (BGBl. No. 140/1979 as amended). Since the products offered on our webshop are intended for consumers, these GTC do not apply to companies.

Offer and Conclusion of Contract

(1) The products depicted in the online store constitute a non-binding invitation to customers to order goods. These include, among others, boards made of real wood, so individual specimens may differ in size and appearance from the images displayed, but they are only similar.

It is also pointed out that the products are made of wood, which can be affected in their usability and safety by natural wear and tear, improper storage (especially in humid conditions), and improper use.

(2) The following rules apply to an order in our online store:

The consumer submits a binding contractual offer by successfully completing the order process provided in our online store.

The order process consists of the following steps:

Selection of the desired goods Confirmation by clicking the "Order" button Review of the information in the shopping cart Clicking the "Proceed to Checkout" button Logging in to the online store after registration and entering the customer's data (email address and password). Rechecking or correcting the respective entered data. Clicking the "Place Order" or "Buy" button. Binding submission of the order by confirming the GTC. Before bindingly submitting the order by clicking the "Place Order" button, the consumer may return to the website where the data is recorded by using the "Back" button contained in the internet browser used by him/her and check the data entered and correct any input errors, or cancel the ordering process by closing the internet browser.

(3) We confirm the receipt of the order immediately by an automatically generated email (order confirmation). However, this does not yet constitute an acceptance of the offer.

(4) We accept your order (offer) in a separate email, which will be stored. Our acceptance declaration also contains your order data, invoice, our GTC, and a specific revocation notice with a revocation form. We will store your invoice and order data.

(5) The goods will be subsequently dispatched. You will receive another email informing you of the shipping date, carrier, tracking number, and estimated delivery time. The goods should arrive at your location within 21 days after that.

(6) However, we reserve the right to refuse your offer without giving reasons. If a payment has already been made, it will be refunded within 14 days.

(7) You can view your previous orders in our customer area under My Account -> My Orders. You will receive an email to the email address you provided.

Prices, Payment, Shipping Costs and Due Date, Refunds

(1) The prices shown are final prices in EURO, including 20% value-added tax. The amount shown at the time of the binding order applies.

In addition, shipping costs apply, which depend on the shipping method, size, and weight of the goods ordered. These shipping costs are indicated in the order summary, which you can view before clicking the "Place Order" button.

(2) Payment can be made by:

Credit card (Visa, Mastercard, American Express) PayPal Direct debit

(3) Any customs duties that may be incurred must be paid by the recipients of the goods.

(4) Refunds of payments already made will be made within 14 working days of receiving the returned goods, without charging any account fees, to the bank account you provided (IBAN and BIC).

Delivery

(1) Delivery will be made within 21 working days at the latest after receipt of payment to the delivery address provided by the customer. If the deadline falls on a Saturday, Sunday, or public holiday at the place of delivery, the deadline ends on the next working day.

(2) In addition to the ordered goods, the delivery will include a return label as well as usage instructions and warnings. These can also be found on the website.

(3) Laurin Marcel Medwed e.U. is liable for damages caused during shipping. Such damages should be reported immediately to the carrier and also communicated to info@stickyslat.com with supporting photos.

Right of Withdrawal for Consumers - Return and Exchange

(1) Consumers have a right of withdrawal for goods purchased online.

Consumer means any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed (§ 1 para. 1 Z 2 of the Austrian Consumer Protection Act).

(2) In the event of a return of the goods, please use the addressed return label (unpaid) enclosed with the goods and check the accuracy of the order number stated.

(3) Customers bear the direct costs of returning the goods when exercising the right of withdrawal.

Revocation Policy

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

To exercise your right of withdrawal, you must inform us

by means of a clear statement (e.g., a letter sent by mail or an email) about your decision to withdraw from this contract.

If you wish, you can use the attached withdrawal form for this purpose.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse you for all payments we have received from you, including the delivery costs (except for the additional costs resulting from your choice of a different type of delivery than the standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the returned goods. We will use the same means of payment for this refund as you used for the original transaction unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.

Return costs due to a withdrawal will not be covered.

The goods must be returned immediately and in any case no later than fourteen days from the day on which you informed us of the withdrawal of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

End of Revocation Policy

Return of Goods

When returning the goods and accessories, if possible, please use the original packaging, even if it should be damaged by an opening for functional testing. Pack the goods in such a way that their damage or loss is avoided. Please use the enclosed return label attached to the goods and check the accuracy of the order number stated.

Warranty Rights

(1) The statutory warranty rights apply.

(2) Shipping costs incurred within the scope of the warranty will be borne by Laurin Marcel Medwed e.U.

(3) For a smooth process in the event of a defect that already existed at the time of delivery, we recommend that you report this immediately upon occurrence with corresponding proof photos and order number by email to: info@stickyslat.com.

(4) A warranty claim does not exist in particular in the following cases:

a) in case of damage caused to the customer by misuse or improper use, b) in case of damage caused by the products being exposed to harmful external influences by the customer (especially extreme temperatures, humidity, extraordinary physical or electrical stress, voltage fluctuations, lightning, static electricity, fire, etc.), c) in case of a defect caused by improper repair by a service partner not authorized by the manufacturer, d) if the goods were damaged by improper or unforeseeable processing, e) if the deterioration or loss of the goods is attributable to the consumers. (5) In the case of a repair requested by consumers, which is not necessary due to a defect, consumers bear the shipping costs. The return label can also be used for this purpose. The provisions under point 7 apply to the shipping.

(9) Before shipping, items added subsequently to the product must be removed. Laurin Marcel Medwed e.U. is not obligated to inspect the product for the installation of such items. Laurin Marcel Medwed e.U. is not liable for their loss.

Applicable Law

The contract concluded between customers and Laurin Marcel Medwed e.U. is exclusively subject to the law of the Republic of Austria, expressly excluding the UN Convention on Contracts for the International Sale of Goods and the reference norms (in particular IPRG). The mandatory provisions of the state in which the consumers have their habitual residence remain unaffected.

Jurisdiction:

The competent court at the place of residence of the consumers is responsible both in terms of subject matter and local jurisdiction.

Dispute Resolution

General information on alternative dispute resolution according to Art. 14 para. 1 ODR Regulation and § 7 Alternative Dispute Resolution Act (AStG):

The European Commission provides a platform for online dispute resolution (ODR), which you can find at http://ec.europa.eu/consumers/odr/.

We are willing to participate in a dispute resolution procedure before a consumer arbitration board.

Usage Instructions and Warnings

Various products offered in the online shop contain safety instructions and usage instructions when delivered. These are part of the GTC. To prevent injuries and damages, it is strongly recommended to read and consider these before use.

The neodymium magnets contained in the products pose various dangers.

Due to their composition and structure, the boards are not suitable for use in skate parks and under extreme loads.

No liability is assumed for damages resulting from non-compliance with the warnings and usage instructions.

Final Provisions

(1) Should individual provisions of this contract be or become wholly or partially ineffective or void, the validity of the contract as a whole shall not be affected thereby, insofar as a contractual partner is not unreasonably disadvantaged by this.

(2) Changes or additions to this contract require written form.

Contract Language

The contract language is exclusively German.
